Don Henley of the band Eagles brought charges of theft against a party of three men that had possession of his handwritten notes and lyrics for their Hotel California record. The Manhattan criminal court case has been in the news lately, and it was suddenly stopped when a judge in the case determined Henley had manipulated prosecutors and possibly made false statements via withholding of evidence.

A declaration of nolle prosequi was filed by the prosecution and everybody is going home...except for Henley and possibly Irving Azoff (Eagles manager), who may face charges of abuse of attorney-client privilege. Sounds to me like a money grab by Henley.

I remember when that happened.It was 2 naked 16 yo girls,Don and Glen,and a pile of Quaaludes and some powder.I think they had a change of mind when they realized past behavior will be brought out.

The whole thing is weird.
Since when is it illegal to be in the possession of someone's materials? Can you prove it was stolen?
I wonder if I have a receipt for that pick Hendrix pick threw into the crowd in 1970? Uh oh....

No love for Don here, but not a "money grab."

This was a criminal case that was initiated at the behest of Don. He didn't stand to get
any dough.

However, he was apparently not fully forthcoming about the facts.

Sounds like he used attorney-client privilege to avoid turning
over to the defense a tranche of emails. When arms were twisted (probably, the judge
told Henley that if he has exculpatory evidence and he's not turning it over, the
case would be tossed.). So he waived A/C privilege and the emails shone a different light
on the case, causing the judge to dismiss the criminal complaint.

He strikes me as a cantankerous b@st@rd. I wonder if the defendants will now try to sue
him for malicious prosecution...

As I understand the background, the entire thing began with a writer in the 1970s who was working on a book about the band. He requested some materials from Don, who handed them over with no expectation of having them returned. At the time, the Eagles were a band that were starting to get some traction but had not yet made the leap to Superstar Rock Gods status.

The book project languished and never was completed. Several years ago (the Eagles are now a Big Thing) some of these notes appeared on fleabay or some other rock-and-roll-collectables auction site and Don caught wind of it, claiming the stuff was stolen from him. Pretty sure that's the short version of the story.

That's why I mentioned the 'money grab' aspect of the case--because someone was making money off the Eagles name and Don wasn't getting a cut.

I don’t see how he was going to make money in a criminal trial.

Yeah, it wasn't a money-making thing. I think it was more about someone making money on the Eagles legacy and Don not getting any; he was trying to prevent these guys from getting a payday on his behalf.
