    They are based in Wisconsin.

    Like the Green Bay Packers.

    And me.

So they are cool, I am guessing

I always loved the Mojo Nixon song "Don Henley Must Die". Henley even performed it on stage with Mojo one time. Mojo has a program on XM/Sirius 60 Outlaw Country.

I have never cared for Henley or the Eagles very much. I remember watching an Eagles video a few years ago. I said to a friend, I'll bet everyone on that stage is an insufferable ***** except Joe Walsh." They take themselves far too seriously, IMO.

Of course I'm not an attorney. I'm a musician.
Because of that, I'm also delusional, believing that a jury would not choose to award money to Don Henley on such evidence.
If someone says to me "take it easy" as a salutation, I do not immediately think Don Henley. And I think a majority on a jury would agree with me.

read the fine print. two wisconsin guys started it and sold out....

it is all fluff and marketing...

the packers and cheese are real... DTC not so much...

blowtorch, Bud Selig is a wisconsin guy too... Selig makes Henley look like U Thant.

consider this: When you read the ad, did you make the connection? If not, then your thoughts make total sense to me and I get it.

If you did get the 'joke' and saw the connection, then the jury would too and if they were amused by it... then DTC would have a problem.

it would come down to which jury you got. I can just hear the lawyers asking "so, do you listen to classic rock...."

if you saw the ad and 'got the reference' DTC has a potential problem. If you saw the ad and didn't... maybe not...

I wonder if the copy writer did it intentionally or not... what do you think?

As I've stated many times, I have a love/hate thing with the Eagles. But I can totally understand them wanting to protect their copyrights/trademarks etc. I think it was a good pun, but it was poor judgement to use it in their advertising.

On the other hand, Jason Lollar has had some problems with Rickenbacker. He does make this one with some reference to a famous 12 string player that does not endorse his pickup. BTW, he's making "Horseshoe" pickups again with the blessing of Rickenbacker. They aren't cheap.

Caddo Lake looks pretty cool. Would love to see it some day, but I hope that old arm-crossed curmudgeon in the floppy hat isn't there. Would spoil the peaceful vibe :D

As far as the ad: IMHO they so cleverly worded it that Henley has no case. He should just ask for some free floppy hats and henleys, and head back to the lake.

Henley may be an ass, but I don't blame him for suing, and it looks like he's got a good case.

They sell good stuff. It's on the expensive side, but quality wise much better than the stuff at Walmart or the local farm store. For what it's worth, they do sell a line of blue jeans that are American made. They're pricey as hell, but last for years.

As for the Henley thing, the lawyers on both sides are going to be just fine. Duluth Trading's 'aw shucks!' persona is carefully crafted by an ad agency. Henley's personality is what he made it. It's not like this is a David and Goliath thing, more like a slap fight between Lindsey Lohan and Kim Kardashian. It might be entertaining, but not meaningful in any way.
