Don Henley STILL way too sensitive

    Can't say I blame him. If they're going to take his name for their own profit, at the very least he should get a cut and/or his permission.

    It says a lot about Duluth Trading company that they would even think that anyone buying their stuff would get the reference.

    As it is, they knew what they were doing (amateurish as it is, it is something stupid like I would do) and they are using Don Henley's name to sell their stuff... if he doesn't protect against that, he has given up his rights...

    Duluth makes out like a bandit though... because Henley IS important (or nameworthy) they will get lots of free advertisement out of the 'controversy' and so, they win.

    Henley (an easy target and probably not even aware of the whole thing) will again be portrayed as the ogre and play the role...

    And we'll all sit in judgement just sure that we aren't the actual pawns in the game.

    who still sells tons of tickets and records and is in the HOF and has clothes places still referencing him because he still matters TO THEM.

    You help him.

    You do care.

    You just don't realize it. Don Henley matters to you because you go out of your way to post about him. This is similar to little kids who talk about how much they hate the little girl they have a crush on.... you have a man crush on Henley.. c'mon man, its okay...

    when we get down to the heart of the matter... your will gets weak... you are just giving ol don the best of your love!

    That's one of my favorite songs of his - and, "Heart Of The Matter" (most especially the "Hell Freezes Over" acoustic version of latter song - brings a tear to this dude's eye every time....

    Sadly, Henley will leave the planet leaving a dual legacy behind...
    of being a great musical contributor and being a difficult person to deal with (to put it mildly)
    The world is full of cheaters, thieves, liars, and con artists. You gotta give credit where credit is due...at least he stands up to them, calls them out, and not only says something about it, he does something about it. It seems that what irritates people to no end is the knowledge that he is usually in the right with every issue he's taken on.

    They just went too far. Duluth Trading's mktg dpt is too clever by half, always has been.
    A Henley is a type of shirt. To don is to wear.
    They should have left it at that.

    Joe Walsh is the only member of the Eagles, except that bassist they nabbed off Poco and maybe Felder, that I would have a drink with.

    I saw a documentary about them where they talked candidly about the history of the band. I'm surprised they found the time to make music. Don Henley seems like he could be gifted a billion dollars and find a reason to sob about it. Glenn Frey seems to think he's a straight-talking tough guy. Does he have little man issues or something?

    I'll be sure to let them know which members you'd be willing to have a drink with!

    Frey is 5'9" so, kind of small, but not small like, say, Jeremy Spencer or Peter frampton....

    Both Eagles bassists were members of Poco and both chose the Eagles just as fast as a person can say yes.

    It is likely you are correct that Henley might find fault with a billion dollars... or even have a conversation about the possibility of that sum.

    If that case were presented to a jury, I don't believe he would win.
    "Don a henley." means "wear a type of shirt".
    A henley shirt is definitely a casual or easy style to wear, as opposed to a suit & tie.
    "Take It Easy" is a term used ubiquitously before it was the title of a JACKSON BROWNE song.
    If Don H. Henley had writer's credit on the song, it might be worth a lawsuit.

    20.00 says you aren't an attorney that pleads cases on this topic.

    In the trial, they would establish that the copy group knew exactly that they were making a 'pun' of sorts (playing on the famous eagle name and song) and the song (co written by Browne, Souther and Frey) is most identified with the Eagles... and how that 'pun' suggests an endorsement of sorts and associates the Eagles with the product and how that would benefit DTC.

    The purpose would not be millions in damages but to protect the Henley/Eagle brand...if they don't then they set a precedent and others can use their name to benefit their brand.

    The goal would be to make DTC spend lots of money beyond any money they would earn with the ad and use it as a way to dissuade others from using such tactics to sell goods.

    The DTC is largely a myth. Do a little research.. they aren't your next door neighbor running a little online company... they are calculated and clever and probably gambled on this.
