I think it's in the harmonic E-minor scale.

Minor/Major 9th chord.
Yes, from the E harm. min. scale. Here it is in 'E' (minor) Low to high: E G B D# F# ----2---- ----4---- ----4---- ----5---- ----X---- ----0---- If you want, you can barre across the 2nd fret from the 5th string (that'll give you another 'B') to the 1st string. |

Personally...
...I do it this way:
Assuming standard tuning: E B G D A E ...use these three chords: First beat: 0 3 2 3 0 x Second beat: 0 3 2 3 1 x Third beat: 0 3 2 3 2 x Fourth beat (like the second beat): 0 3 2 3 1 x Only the A string changes. Hit the A on the downbeat and the others on the upbeat. You know the timing. I don't know the right way, but this way sounds fat! |

0 10 9 8 7 x (low to high) same notes as klasaines example.

it's the same chord as klasaines, an Em/maj9
Skrik, it's not an Em7/maj9 because the 7 in this chord is a major seven. the function of the notes is, from low to high, Root, b3, 5, maj7, 9
