Legal Action Threat

Today an effects pedal vendor filed a DMCA complaint (Digital Millennium Copyright Act) against the TDPRI and threatened legal action to force us to remove an image from the this forum.

We have complied with this vendor's request -- and to insure that we have no more such problems we have removed all posts that referred to this vendor and his products. We have also censored his name and web address so that they may not be used.

We wanted you to be aware of this should you type the web address of a stomp box maker and see nothing but www.*************.com

I don't know who it is, but all I can do is shake my head in disbelief. And never buy their pedals when I find out who it is. Of course, I might never have wanted any of their stuff anyway.

Wow, what a great way to lose lots of potential (and current) business. Kudos to whomever it was.

I'm glad the hassle wasn't greater than that.

Hmm, I can only guess... the same ijiots that caused TGP to "freak" out???!?!

Certainly would be their style...

+1!

I'll imagine that it was the over-zealous efforts of a legal person who didn't appreciate the nuances of user forums and their ability to help promote a vendor's product.

Agreed, though now I too am interested.

Only because I want to make sure not to purchase anything they make. This is taking it too far IMHO. Pedals must not be that good if they don't want a few guys on TDPRI talking about them.

Why would they want to loose the free advertising? Maybe you ought to offer to reinstate thier name and pictures if you charge them a fee. Clicking on the initial link did not take me anywhere....

re "the same ijiots that caused TGP to "freak" out???!?! "

I think it's pretty obvious who it was, you wouldn't want any of their products if you know the story behind them.

For those of us who are clueless, other than counting 13 asterisks, whoever these guys are I would like to know so I can refrain from giving them any money. Some way to give us a hint?

Yep.

To the admin, we're dealing with the same stuff over at FreeStompBoxes (I'm a moderator there). If you want to discuss anything in particular, please feel free to send me a PM and we can take it from there. We've done a ton of legal research on DMCA counter-notices and the overall process in general.

Just do a search on here of your favorite (or least) manufacturer and see what doesn't return any results. I checked a few. I recommend not naming any names in an effort to keep this place and the folks who run it out of any hassle.

Let's just say that the average player isn't affected. Only cork-sniffers.

Steven Seagal probably has their entire pedal line, but paid way more than he should have

Found it in the cache. I never read any of those threads, and never heard of that manufacturer. Very distasteful, the whole thing.

I'm clueless...I don't buy many pedals, nor use them that much...but I'd like to know who so I don't make that mistake (and tell my friends). If someone would PM me and let me know I'd appreciate it. Thanks.

www.*************.com being said...what's the deal behind the pedal in question? I watched a couple of vids on it, and it does sound pretty doggone good. I want one. Talk me out of it. Please.

Over a pedal design so old that the club was barely invented yet????!!!
That is just crazy......
And to (miss)use the DMCA for that....awesome...

Makes one think about putting a schematic along with the pedals we make for the future, just for repairs....as they are nothing but general and very common.

To the best of my knowledge it is a pedal that has been repainted, has had the manufacturer's print on the PCB scratched out, one or two component changes [if any], and sold for 7x more than the original price. I may or may not have an "unmodified original" pedal made by the manufacturer in question on my pedal board... Which is in my signature, and may or may not have a giant smiley next to it.

Well that would be outright FRAUD... if that were the case. Even if a few minor changes were made, or IF a bunch of goop was smeared over the original designer's scratched-out name, in a way that made it look like components were there... IF that happened, of course.

What FOOL would do that, then threaten large internet forums with lawsuits, when they'd best be running for the border with wads of cash?

That was an interesting google cache read, and some fine mess this now not to be mentioned builder got himself into.
