Ownership Question

I'm pretty sure we're okay on this, but thought I'd get some other opinions...

We recorded some basic tracks, mostly rhythm, but vocals and leads are there for scratch purposes.

Anyway, the sessions went south and we decided not to work with the producer who paid for the studio time. It was a mutual decision.

He had said he would pay for the sessions and take his money from CD sales and a percentage of publishing if anything came of the songs. Nothing was ever signed.

So he's eating the cost of two days recording and I suppose he owns the tracks. But we have copyright on all the originals. We publish our own work but have not done it with these, (you need a runtime for BMI, et al, and these songs hadn't been recorded.)

Does anybody think there's anyway the producer can release our work?

I'd check with an attorney just to be sure. A verbal agreement is one thing but rights/ownership is another. Most rational folks eat their losses and move on, some don't. He could be a di*k and throw it out on the internets just to be one. If it was an amicable seperation, you should be good, just ask. I'm sure you could better your stance by offering compensation for studio time as well.

Who owns the recorded tracks? Are they on somebody's personal hard drive, or does HE own them?

Well, if we could have afforded studio time there wouldn't have been an issue. Anyway, the tracks weren't finished, we don't want them.

If he does release them I doubt anything will come of it. (And if it does, say Emmylou decides to record one of the tracks, we win.)
